MAIN SERVER RULES a. No large / dedicated file download sites. b. Not to be used in conjunction with PC backups, our servers are for website contents only. c. No large mailing lists used to spam / abusing mail server. d. No scripts that may/can risk the security of our server, anyone risking our servers will have their services terminated. The order form completion represents the electronic signing of this document. 5. ENTIRE AGREEMENT; SERVICE AGREEMENT IDripp. shall provide its Services to You (the Customer) under the Terms and conditions of this IDripp. Customer Agreement. The Agreement is intended to keep the integrity of both IDripp, and the Customer and to protect both parties from liability. This Service Agreement will be enforced to ensure the speed, power, performance, and reliability of our services. Along with the Order Form and any other documents or agreements explicitly specified in this Agreement, the Customer Agreement constitutes the whole act of convention between IDripp, and the Customer, thus being the most significant document of the newly-established relationship. In case that a court of competent jurisdiction considers that any of the Agreement's provisions is invalid, unenforceable, or void, the remaining ones will completely reserve their validity. Customer's side of the Agreement could be presented by the following parties: an individual with personal demands, being over 16 years of age. IDripp assumes no responsibility for the timeliness, deletion, failure to deliver or store any Customer communication or personalization settings. 6. SERVICE GUARANTEES IDripp will guarantee network uptime and 99.9% network stability uptime. This, however, does not refer to problems stemming from: a. Server Hardware Breakdown b. User error(s) or purposeful interruption(s) of the user service (e.g. if the client shuts his/her own server down, IDripp. is not responsible for the downtime) c. Failures due to software that is not explicitly supported by IDripp. Consequently, if a hardware crash provoked by the customer happens, IDripp. is beyond the control and responsibility for the resulting downtime. 7. MONEY BACK GUARANTEE IDripp offers a 30-day money back guarantee. If your website expiriences any downtime or IDripp expiriences any server failure, you can request and receive a full refund for your hosting plan within 30 days after you purchased the account. However, we do not offer 30 day refunds unless IDripp expiriences a server failure or your website is down for more than 1 day, all domain registrations are final, and do not include any money back guarantee, All refunds will subtract domain registration & SSL certificate, shoutcast, shoutcast reseller fees and Addons are non refundable. 8. PAYMENT AND REFUNDS . Refunds are credited back to the same account & payment method made on first payment. Please see above (Money Back Guarantee) to see if you are entitled to a refund. a. Quarterly, Semi-Annually & Annually paid plans cancelled after 30-day money back guarantee are not entitled to a full cash refund for none-used time and can only have money credited to our system for further hosting accounts you may take out with us. You may sell your account credit to another person but must contact us before. b. Addons & one-time payments are not refundable. c. Domain names are not refundable, once registered the domain name is owned by you. 9. WARRANTIES AND REPRESENTATIONS IDripp provides hosting services on an "as is" and "as available" basis without warranties or representations for its offering. We bear no responsibility for connection problems, in cases when customers hosting with IDrip confronts with service interruption issues. 10. DOMAIN NAMES Domain Names with IDripp are property of the client and all domain whois details are also in the clients name. Clients have full access to Domain Names 24/7 to changed/edit whois details, unlock/lock Domain, change/edit nameservers, disable ID Protection and access to EPP Code for transfers. Web hosting accounts with free domain name included (when cancelled) must have atleast paid the value of the domain name to keep the ownership of the domain(s). Accounts paid under the value must pay the difference before the domain ownership can be kept, failure to do this may result in your domain name been sold. 11. THIRD PARTY Any dealings with third parties (including advertisers). Services or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. IDripp shall not be responsible or liable for any part of any such dealings or promotions. 12. BILLING AND SUSPENSIONS All IDripp packages are set with their individual payment plan, payments must be made on time at all times. Late payments may affect your account or offers attached to it. Payments overdue can lead to account suspension then termination. Accounts overdue 4 days will be automatically suspended and a late fee of 10% will be charged to your account (Late Payment of Commercial Debts (Interest) Act 1998). Accounts reaching payment deadline of 10 Days your account will then be placed on the pre-termination list. Account reaching per-termination will be reviewed, we will try to contact you and could then be terminated. Suspended accounts can not be logged into, receive, send or view Email nor have access to your site. For suspension to be lifted all overdue invoices for the service must be paid. Accounts overdue 14 Days will lose any offer or discount attached to it, this includes web hosting & free domain renewal discount promotion codes. If you are having difficultys with your payments (overdue or not) please contact us and we will work around you to be able to manage your hosting payments and choose a plan to suit you. 13. TERMINATION IDripp, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service if you violate these terms. Accounts inactive with nameservers pointing elsewhere will be warned, if action is not taken accounts may be removed. Accounts found hosting illegal contents will be removed without warning. 14. SERVICE DENIAL IDripp reserves the right to reject its service and terminate this agreement for a certain period of time or indefinitely upon customers failure to pay. The customer then is considered a debtor to IDripp and liable for reasonable interest and collection fees. 15. SHOUTCAST STREAMING IDripp does not actively monitor stream contents and all content broadcast is the sole responsibility of the client. We do not provide any form of legal cover to individuals or companies who utilize our services to distribute content with any copyright protection. Under no circumstances will IDripp be responsible for the behavior of our clients or their users when found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities. You as a reseller are responsible for your streaming clients and their account functions You may not use our services to distribute adult, racist or any other un-sociable material. If contacted by an authority in the event of an illegal situation regarding any of the above, we will co-operate fully in any investigations they decide to make against clients found to be breaking the law. IDripp will make every effort possible to ensure security of client's data, however due to the large volume of media stored, our standard costs do not include backup of data, please contact us if you would like to arrange this at an extra cost. All data is stored at clients own risk and we will assume no responsibility for any loss, damage or corruption of files hosted on our servers. All live streaming purchased from IDripp is limited in bandwidth by a bitrate (X kbps). If you choose to stream above the purchased bitrate on a live server, we reserve the right to terminate your account without warning, refund or explanation. If your account is suspended because of this, we reserve the right to charge a $5.50 admin fee to have it re-activated. 16. RESELLER TERMS You as a reseller, master reseller or alpha reseller is responsible for your clients, their accounts and making backups of any account hosted within your reseller account, you must support them yourself and ensure they do not abuse IDripp servers. IDripp is only responsible for making a backup for your account which you signed up with and IDripp accept no responsibility for any data lost for your clients or any accounts you create within your reseller account. You must make clear our terms to your clients to avoid them breaking our service agreement. If your clients are found breaking our service agreement you will be informed to take action. Please monitor your client’s bandwidth & disk usage to keep track and if you feel an account is been abused, suspend it and inform us to assist you. Please keep your password to your WHM control panel safe and do not hand this over the internet to unknown users for help, this can result in your account been damaged. Any help needed in your account please contact us first. Any account looking like its been abused will result in suspension. Accounts using high amounts of bandwidth can often be due to users not been within our service agreement by large file downloads, full feature movies & PC Backup usage. If you find an account using high bandwidth we ask its checked accordingly. 17. YOUR RESPONSIBILITIES You are solely responsible for the content of your messages. Using the IDripp Service in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise) is prohibited. In consideration of your use of the Service, you agree to: Provide true, accurate, current and complete information about yourself as prompted by the registration form of the Service. a. Maintain and promptly inform us to update Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or IDripp. has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, IDripp has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). b. When signing up for un account with IDripp, each customer agrees to submit correct and up-to-date contact details, meaning that when introducing any changes to this information, he/she is obliged to notify IDripp. in the course of a 10-business-day period after the changes become valid. The introduction of changes should be done online through customers Control Panel, not via e-mail. This requirement is also in force for IDripp. - customers will always be aware of any contact information changes that the company places within its website. This way, a flawless communication process between both sides is guaranteed. c. You will receive a password and account designation about up to 4 hours after completing the registration process of the Service. If you do not receive your account details and activation confirmation. You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your password or account. You agree to: i. immediately notify IDripp. about any unauthorized use of your password or account or any other breach of security ii. ensure that you exit from your account at the end of each session. IDripp. cannot and will not be liable for any loss or damage arising from your failure to comply with this. d. Any Customer in violation of system or network security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, e-mail bombing, flooding deliberate attempts to overload a system and broadcast attacks. Forging of any TCP/IP packet header or any part of the header information in an e-mail or newsgroup posting. e. We accept no responsibility to lost data due to hardware / software failure, backups are your responsibility. Backups made by IDripp are not to be relied on as we can not check if all contents or accounts are acounted for. f. Harm to IDripp. Servers - any attempts for doing harm to a server or customer of IDripp. Services are explicitly banned. Acceptable Use of Services / Acceptable Access to Services - IDripp. will immediately and resolutely react to any attempt of use of an Internet account or computer by a IDripp. customer unauthorized by the account or computer owner. Such attempts include "Internet scamming" (tricking other people into releasing their passwords and etc.), password robbery, security hole scanning etc. It DOES NOT matter whether the attacked account or computer belongs or not to IDripp. Services, the fraud will be subject to actions based on the very nature of the attack which could be a warning, an account suspension or cancellation and civil or criminal legal action. g. CPU usage (or usage of the Central Processing Unit(s)) on the web server Customers account is hosted on is subject to some regulations. That means that each hosting account can take advantage of up to 10% of the CPU power for no longer than 180 seconds at any given time or 3% in the course of 24 hours. IDripp strongly requires that customers be very judicious when using the CPU power for their accounts. Otherwise, we may suspend customer accounts in cases of registered impact on other accounts on the server or disturbance caused to the functioning of the server. If we do suspend an account, then its owner will be notified of that in consistence with the situation that this suspension may provoke. Then the accounts owner may be required to upgrade to a dedicated or semi-dedicated web hosting solution. Possible alternative is a required reduction in the load and traffic that the customer’s account gets. IDripp reserves the right to block files or scripts that use CPU exceedingly and notify clients. h. Users are NOT allowed to send more than 1500 emails per day per hosting account. i. Each account is entitled to host up to 60.000 files. j. IDripp. does NOT allow sites that provide any content, points of distribution, or links to sites that: . infringe on any third partys intellectual property or proprietary rights, or rights of publicity or privacy. i. violate any law, statute, ordinance or regulation ii. are defamatory, trade libelous, threatening, unlawfully harassing, abusive, pornographic or obscene iii. contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of anothers computer or property of another. iv. contain Pirated or Hacking / Phreaking Software (Warez)- Any software that is copyrighted and not freely available for distribution without cost. ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) all fall under this jurisdictio 18. EMPLOYEE ABUSE IDripp does take abuse from customers lightly. Any customer found abusing our staff can have their accounts terminated from our servers and a lifetime ban from using our services. 19. SPAMMING IS PROHIBITED We will determine in our sole discretion whether any of the messages you send are spam. For your information, spamming generally includes, but is not limited to: . the sending of unsolicited messages in bulk, or the sending of unsolicited e-mails, which provoke complaints from recipients a. the sending of junk mail b. the use of distribution lists that include people who have not given specific permission to be included in such a distribution process c. posting commercial ads to USENET newsgroups that do not permit it d. posting articles containing binary encoded data to non-binary newsgroups e. excessive and repeated posting of off-topic messages to newsgroups f. excessive and repeated cross-posting g. e-mail harassment of another Internet Customer or Customers, including but not limited to, transmitting any threatening, libelous or obscene material, or material of any nature which could be deemed to be offensive h. the e-mailing of age-inappropriate communications or content to anyone under the age of 18 i. "Spamming" is considered as explicit misuse of ethical principles and will be interpreted as a violation of them j. The maximum number of allowed e-mail messages sent per day is 1500. There are no exceptions to this rule. Every customer who is sending more than 1500 e-mail messages per day needs a dedicated server and cannot use a shared hosting account. 20. COPYRIGHTS Copyrighted material must not be placed on Customers accounts without the permission of the copyright owners or people that are specifically authorized by the copyright owners. Only copyright owners or people specifically authorized by them may upload copyrighted material to the account. Upon our receipt of a notice of a claimed copyright infringement containing the above information, after confirmation we will promptly remove the allegedly infringing material from the Services and carry out further procedures if necessary. We will assume no liability to any Customer of the Services for the removal of any such material. Please report any violations of the Terms of Service to 21. CHANGES TO TERMS reserves the right to revise its policies at any time without notice.
